Please read these Terms and Conditions ("Terms") carefully before using Automatez ("the Platform", "Service") at automatez.app.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part, you do not have permission to access the Service.

1. Acceptance of Terms

By creating an account or using any part of the Automatez platform, you confirm that:

  • You are at least 18 years of age
  • You have the legal authority to enter into these Terms
  • You will use the platform only for lawful purposes
  • You are responsible for all activities under your account

2. Description of Service

Automatez is a cloud-based CRM and marketing automation platform providing:

  • WhatsApp Marketing: Bulk messaging, broadcast campaigns, chatbots, templates, autoresponders, and WhatsApp Business API integration
  • CRM Tools: Lead management, deal pipelines, contact management, sales forecasting, and task scheduling
  • Email Marketing: Campaign builder, email templates, contact segmentation, and analytics
  • Facebook Lead Ads Integration: Automatic sync of Facebook Lead Ad submissions into CRM with real-time webhook delivery
  • AI & Automation: AI chatbot builder, content generator, smart campaign automation, and IVR call flows
  • Omnichannel Communication: Unified inbox for WhatsApp, Meta (Facebook/Instagram), email, and live chat
  • Social Media Management: Schedule and publish posts across social platforms
  • Commerce Tools: Product catalog, orders, payments, and invoicing via WhatsApp
  • Support System: Ticketing, SLA policies, and knowledge base management
  • API Access: REST API for third-party integrations and webhooks

3. Account Registration

  • You must provide accurate, complete, and current information when registering.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must notify us immediately of any unauthorized account access.
  • One account per user. You may not share accounts or credentials.
  • We reserve the right to refuse registration or terminate accounts at our discretion.

4. Subscription & Payments

  • Automatez is available on paid subscription plans. Pricing is listed on our website.
  • Subscriptions are billed in advance on a monthly or annual basis.
  • All payments are non-refundable unless otherwise stated in our Refund Policy.
  • We reserve the right to change pricing with 30 days' notice.
  • Failure to pay may result in account suspension or termination.
  • You are responsible for all applicable taxes on your subscription.

5. Acceptable Use Policy

You agree NOT to use Automatez to:

  • Send spam, unsolicited messages, or bulk communications without recipient consent
  • Violate WhatsApp Business Policy, Meta Platform Terms, or any applicable messaging regulations
  • Send messages promoting illegal activities, hate speech, adult content, violence, or fraudulent schemes
  • Harvest, scrape, or collect personal data without legal basis
  • Impersonate any person, company, or brand
  • Upload malware, viruses, or malicious code
  • Attempt to reverse-engineer, decompile, or hack the platform
  • Violate any local, national, or international law
  • Resell or sublicense access to the platform without our written permission

Violation of this policy may result in immediate account suspension without refund.

6. WhatsApp & Meta Platform Compliance

  • Use of WhatsApp features is subject to WhatsApp Business Policy.
  • You must obtain proper opt-in consent from contacts before sending WhatsApp messages.
  • You are solely responsible for the content of messages sent through the platform.
  • Facebook Lead Ads integration is subject to Meta Platform Terms.
  • We are not responsible for WhatsApp account bans or Meta account restrictions resulting from your usage.

7. Your Data & Content

  • You retain full ownership of all data, contacts, and content you upload to the platform.
  • By using the platform, you grant us a limited, non-exclusive license to process your data solely to provide the Service.
  • You are responsible for ensuring you have the right to upload all content and contact data.
  • You are responsible for compliance with GDPR, CCPA, TCPA, and any other applicable data protection laws.
  • We do not sell your data or your contacts' data to any third party.

8. API Usage

  • API access is provided for integration and automation purposes.
  • You must not use the API to overload, disrupt, or abuse our infrastructure.
  • Rate limits apply. Exceeding them may result in temporary API access restriction.
  • API keys are confidential. You are responsible for securing your credentials.

9. Intellectual Property

  • All platform content, branding, software, code, and design are the intellectual property of Automatez.
  • You may not copy, reproduce, distribute, or create derivative works from our platform.
  • You may not use our name, logo, or trademarks without prior written consent.

10. Service Availability & Maintenance

  • We aim for 99% uptime but do not guarantee uninterrupted service.
  • We may perform scheduled maintenance with prior notice when possible.
  • We are not liable for downtime caused by third-party services (WhatsApp, Meta, email providers, etc.).
  • We reserve the right to modify, suspend, or discontinue any feature with notice.

11. Limitation of Liability

  • Automatez is provided "as is" without any warranties, express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
  • We are not liable for loss of data, lost profits, or business interruption.
  • Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.
  • We are not responsible for content sent by users through our platform.

12. Indemnification

You agree to indemnify and hold harmless Automatez and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising from your violation of these Terms, your use of the platform, or content you upload or transmit.

13. Account Termination

  • You may cancel your account at any time from your account settings.
  • We reserve the right to suspend or terminate your account for violation of these Terms.
  • Upon termination, your data will be retained for 90 days and then permanently deleted.
  • You may request an export of your data before account deletion.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through binding arbitration or the competent courts of the jurisdiction where Automatez operates.

15. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by email or in-platform notification. Continued use of the platform after changes take effect constitutes your acceptance of the updated Terms.
